عالج أحد السؤالين:
السؤال 1:
نصت المادة 41 من
الدستور: "كل شخص يعتبر بريئا حتى تثبت جهة قضائية إدانته، في إطار محاكمة
عادلة"
تحدث عن الضمانات التي
أقرها قانون الإجراءات الجزائية لتكريس مبدأ قرينة البراءة وتحقيق المحاكمة
العادلة.
السؤال 2:
نصت المادة 39 من
الدستور على حظر أي عنف بدني او معنوي او أي مساس بالكرامة.
أ- ما هي الأفعال التي
يجرمها قانون العقوبات الجزائري ويعاقب عليها بعنوان:
1- المساس بسلامة
الإنسان البدنية.
2- المساس بسلامة
الإنسان المعنوية.
3- المساس بالكرامة.
يجب ذكر كل فعل من
الأفعال المجرمة مع الإشارة على:
- النص او النصوص التي
تطبق على كل فعل، والعقوبة المقررة له.
- الوصف القانوني لكل
فعل (مخالفة/جنحة/جناية).
- إبراز المعيار أو
المعايير التي اعتمدها المشرع الجزائري للتمييز في الوصف الجزائي بين كافة الأفعال
المذكورة.
ب- تخضع متابعة بعض
الأفعال المذكورة أعلاه لقيد الشكوى وتتوقف المتابعة الجزائية في البعض منها بصفح
الضحية:
1- ما هي الأفعال التي

الموضوع 1:
تعد حرية التعبير والرأي
حق من الحقوق الأساسية التي تضمنها مختلف النصوص القانونية الدولية والداخلية، وإن
كان هذا الحق يمارس في نطاق واسع إلا أنه لا يمكن ان يكون مطلقا.
تكلم عن حرية التعبير
والرأي كحق ومسؤولية، ومجال تدخل القضاء لضمان ممارسة هذا الحق ولتوفير الحماية
القضائية للغير الذي قد يتضرر من ممارسته.
الموضوع 2:
لقد تسببت الأزمة الصحية
الناتجة عن جائحة كورونا في تدهور الأوضاع الاقتصادية في كل دول العالم وساهمت في
تفاقم التفاوتات الاجتماعية والاقتصادية بين البلدان الأكثر تقدما وتلك الأشد فقرا
من جهة، وأيضا بين مختلف الفئات الاجتماعية في الدولة الواحدة من جهة أخرى.
- ما رأيك / ما هو
تعليقك على ذلك؟

De toutes les
ressources terrestres, l’eau est la plus précieuse. Sans elle, aucun animal,
aucune plante, aucune forme de vie ne serait jamais apparue. On peut vivre sans
nourriture pendant plusieurs semaines, mais le manque d’eau tue en quelques
jours. L’homme lui-même est composé d’eau pour 65%
Chaque
goutte, datant de l’époque où se formait la planète, est demeurée sur la terre.
Etant en perpétuel mouvement, elle a fait plusieurs fois le tour du globe.
Soustraite à l’océan, sous l’effet de la chaleur solaire, elle contribue à la
formation des nuages que poussent les vents. Elle peut tomber n’ importe où,
sous toutes les latitudes : en pluie, en neige, en grêle. Elle put séjourner
indéfiniment sur les sommets montagneux ou retourner rapidement à la mer à
travers égouts et rivières. Presque toute l’eau terrestre se trouve,
aujourd’hui, dans les océans. C’est là que la vie a commencé.
A une époque
indéterminée, il y a vraisemblablement trois milliards d’année de cela, des
substances chimiques en suspension dans le chaud « bouillon marin » se sont
combinées les unes aux autres pour former des molécules dorées d’une
extraordinaire aptitude : celle de se reproduire.
L’eau donne
la vie, aussi faut-il éviter de la polluter

A drug dealer
has been jailed for more than 13 years
after the police got his ID (identification) from the fingerprints he left on a
block of cheese Carl Stewart, 39, from Vauxhall, Liverpool , used the Encro
Chal * encryption service to evade detection as he supplied class A and B
drugs, He used the handle ‘Toffee force’ to hide his identity, but law
enforcement agencies managed to crack the encryption device. Stewart was
identified after he shared an image of a block of cheese in the palm of his
hand, and his fingerprints were analysed.
He was jailed
for 13 years and six months on Friday 21 May after he pleaded guilty to
conspiracy to supply cocaine and conspiracy to supply heroin at Liverpool Crown
Court.
Stewart also
pleaded guilty to conspiracy to supply MDM, conspiracy to supply ketamine and
transferring criminal property.
